Three people were arrested in Manaus for fraudulently selling oxygen cylinders an NGO. According to the Civil Police, the arrests took place last week.
In January, at the height of the health crisis in Amazonas, one of the suspects, João Victor Araújo da Silva, became a volunteer for the NGO to steal the oxygen cylinders. The police reported that João Victor may have deflected more than 60 cylinders. He even sold each cylinder for up to 6 thousand reais.
Silva remains in prison. The other two members of the gang are already free. Everyone will answer for the crimes of qualified reception, criminal association and embezzlement.
Can the volunteer be charged with attempted murder?
It is very difficult to frame the case as an attempted homicide, since it would have to be proven that one of the cylinders diverted by the volunteer would be used on a specific person, who died or had a severe worsening demonstrably due to the lack of diverted oxygen. Haidar points out that, although complex, some Prosecutor may try to make inquiries along these lines.
In addition to being responsible for the series of listed crimes, if it is bought that the cylinders were paid for with public money, the volunteer involved in the action may also be responsible for embezzlement, which is defined by the Penal Code (article 312) as the appropriation by a public official, of a property to which he has access because of the position he holds, with a penalty of two to twelve years, in addition to a fine.
